These Terms and Conditions ("Terms") govern your use of the zaptrono.com website and your engagement of renovation services offered by House Sanctuary Builders Pty. Ltd. ("we", "us", "our"), a company registered in the state of Victoria, Australia. By accessing this website or entering into a service agreement with us, you agree to be bound by these Terms in full.
Acceptance of Terms
Your continued use of this website and any request for our services constitutes acceptance of these Terms. If you do not agree with any provision outlined below, you should discontinue use of the website and refrain from engaging our services. We reserve the right to refuse service to any party at our sole discretion.
Description of Services
House Sanctuary Builders Pty. Ltd. provides residential renovation and building services throughout the Melbourne metropolitan area and selected regional locations in Victoria. Our services include, but are not limited to:
- Kitchen, bathroom and laundry renovations.
- Full home renovation and refurbishment projects.
- House extensions, including ground-floor and upper-storey additions.
- Apartment and unit fit-outs.
- Project management, design consultation and council permit coordination.
All building work is carried out by licensed practitioners registered with the Victorian Building Authority (VBA) and in compliance with the Building Act 1993 (Vic) and the National Construction Code.
Quotes, Pricing and Payment
Quotes provided by us are based on the project scope, specifications and site conditions known at the time of assessment. Unless stated otherwise, a quote remains valid for thirty (30) days from the date of issue. Prices are quoted in Australian dollars and are inclusive of GST unless explicitly noted.
Variations
If additional work is required beyond the agreed scope — whether due to unforeseen site conditions, changes requested by the client, or regulatory requirements — we will provide a written variation detailing the additional cost and timeline impact before proceeding. No variation work will commence without your written approval.
Payment Schedule
Payment terms are set out in the individual project contract and typically follow a staged schedule aligned with construction milestones. A deposit is required before work commences. Progress payments are due upon completion of each defined stage, and the final payment is due upon practical completion and handover. Late payments may attract interest at the rate specified in your contract.
Project Timelines
We provide estimated timelines for each project based on scope, complexity and material lead times. While we make every reasonable effort to meet these estimates, completion dates may be affected by factors beyond our control, including:
- Adverse weather conditions that prevent safe or compliant construction.
- Delays in council permit approvals or inspection scheduling.
- Supply chain disruptions affecting material availability.
- Changes to the project scope requested by the client after work has commenced.
We will communicate any anticipated delays to you promptly and work to minimise their impact on the overall programme.
Client Obligations
To enable us to deliver our services effectively, you agree to:
- Provide accurate and complete information regarding the property, site access and any known issues such as asbestos, heritage overlays or easements.
- Obtain any approvals, permits or consents that fall outside the scope of our agreed services.
- Ensure reasonable access to the project site for our team and subcontractors during agreed working hours.
- Make payments in accordance with the agreed schedule and respond to variation requests within a reasonable timeframe.
- Notify us promptly of any concerns about workmanship or materials so they can be addressed during the construction phase.
Intellectual Property
All design documents, architectural drawings, 3D renders, specifications and proprietary construction methodologies created by House Sanctuary Builders Pty. Ltd. remain our intellectual property unless expressly assigned to you in writing. You are granted a licence to use these materials solely for the purpose of the contracted renovation project. Reproduction, distribution or use of our materials for any other purpose without prior written consent is prohibited.
Limitation of Liability
To the maximum extent permitted by law, our liability for any claim arising out of or in connection with our services is limited to the total contract value of the relevant project. We are not liable for indirect, consequential or incidental losses, including loss of profit, loss of use of property, or costs arising from alternative accommodation arrangements, except where such exclusion is prohibited by statute.
Nothing in these Terms excludes or limits any consumer guarantee under the Australian Consumer Law that cannot be lawfully excluded.
Dispute Resolution
In the event of a dispute arising from these Terms or any project contract, the parties agree to follow this resolution process:
- Step 1 — Direct negotiation: The parties will attempt to resolve the matter through good-faith discussion within fourteen (14) days of one party notifying the other in writing.
- Step 2 — Mediation: If direct negotiation is unsuccessful, the dispute will be referred to a qualified mediator agreed upon by both parties, or appointed by the Resolution Institute. Costs of mediation will be shared equally.
- Step 3 — Statutory avenues: If mediation does not resolve the matter, either party may pursue remedies through Domestic Building Dispute Resolution Victoria (DBDRV) or the Victorian Civil and Administrative Tribunal (VCAT), as applicable.
Governing Law
These Terms are governed by and construed in accordance with the laws of the state of Victoria, Australia. Both parties submit to the exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.
Modifications to These Terms
We may amend these Terms at any time by publishing the revised version on this page. Changes take effect from the date they are posted. Your continued use of the website or our services following any amendment constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.
